Adi Godrej wins case against cybersquatter

Adi Godrej, chairman of Godrej Consumer Products, has won a case against a cybersquatter who had registered the domain name 'adigodrej.info', a law firm representing Godrej said.

Nidhish Mehrotra, co-founding partner at law firm ANM Global said, "Allowing this domain name registration would have harmed the Godrej brand and could have had serious consequences for the company under the Amended Information Technology Act of 2000." Under the provisions of this Act, if a corporate does not take measures to safeguard its data, it could be held liable for any lapse in its data security, and is liable to pay compensation up to Rs 5 crore.

"Generally people register such domain names so that they can sell it at a good price later or even misuse it. Before any damage can be done, we found out about it and decided to take the matter to court," said Rajeev Bakshi, executive vice-president, legal, Godrej Group.

"The matter was heard in Geneva and it took us two months to win the case," he added. Under the uniform domain name dispute resolution policy, Godrej proved that the domain name registered by cybersquatter US-based Bruce Wayne was identical to its trademark and misleading, ANM Global said.

Legal experts say cybersquatting leads to dilution of the brand in question and could lead to bigger cases of cyber fraud.
