SONY TAKES ONEPLUS 3T TO COURT

Sony Pictures Networks India (SPN) had filed a copyright infringement plea against the Chinese mobile manufacturer OnePlus over a television advertisement. The new television advertisement of OnePlus, shows Amitabh Bachchan reinforcing OnePlus 3T, as the best smartphone of the country. The rating was allegedly based on the "current model smartphone ratings on Amazon India."

The ad-campaign of OnePlus 3T was shot in an arguably similar format to ‘Kaun Banega Crorepati’, the rights of which are owned by SPN. SPN had filed a petition seeking to stop OnePlus from airing the advertisement on grounds of copyright infringement.

The ad goes on to show how the contestant throws the question back on him, and Amitabh Bachchan is seen taking the hot seat and asking for an audience poll.

SPN approached the court asking for an ex-parte ad-interim injunction, after the ad-campaign went on-air.

SPN claims that before using the show (Kaun Banega Crorepati) format or any clip, every company is expected to take prior permission from Sony. The ad in question is an extreme case of unfair competition and it infringes rules of intellectual property rights.

On March 30, 2017, the Delhi High Court, granted an ex-parte ad-interim injunction order against OnePlus, restraining them from airing the advertisement titled 'Best Smartphone Contest', promoting sale of OnePlus 3T on any channel or on print or any other media or doing any other act that could infringe SPN’s copyright or other IP rights, or account to unfair competition.
