By Ms. Divya Sharma, Head - Food Law Practice

Through a notification dated 2nd March 2017 and as a response to the numerous representations received by the FSSAI, the last for the declaration of class titles, trans fat content and saturated fat content, has been extended to 30th June 2017.

Through their original notification dated 4th August 2015, FSSAI had limited the use of trans fat up to a maximum limit of 5% by weight. Accordingly, every package of edible oils, interesterified vegetable fat, both hydrogenated or partially hydrogenated oils, edible fats, margarine and fat spreads (mixed fat spread and vegetable fat spread) and package of food in which fats, oils and fat emulsions is used as an ingredient shall declare the quantity of trans fat content and saturated fat content on the nutritional information label as well as make necessary changes in the class title under ingredients used.

Considering the plight of traders who had unutilized stock which had been labeled prior to the coming into force of these notifications, the FSSAI granted relief to such traders to utilize their unsold stock and comply with the present notifications by 28th February 2017.

Thus, the present relief has only been given with regard to declaration of class title, trans fatty acids and saturated fat content on labels. The final date regarding maximum limit of trans fatty acids in food products as not more than 5% by weight remains the same which is, 28 February 2017.
